Standard Terms and Conditions

Aussie Stairs' Standard terms and conditions typically prevail over any conflicting terms provided by the customers.

Payments

COD Customers: 50% deposit required on acceptance of the quote and balance to be paid day before the materials delivered on site for each section of the job. 

Credit approved customers: 50% deposit required on acceptance of the quote and balance due 14 days from invoice date 

Jobs above $10,000 require progress payment. 

DIY jobs - Complete payment required prior to start of project. 

Cancellation 

Deposits paid are non-refundable if the job is cancelled or change of mind. Should a job be ordered and no progress with installation taking place within 6 months, we reserve the right to vary the quoted price in line with cost and price increases. 

Drawings

Prior to any drawings commencing there are a number of questions that need to be answered by the Client. The answers provided allow us to commence the drawings. Once these answers are submitted, they cannot be changed. Any variations to these questions do attract an administration cost of minimum $200. 

Additional engineering cost applicable if you require engineering certification.

All Aussie Stairs works are completed to Australian Standards. 

Quotes

All quotations are subject to the final site measure.

Additional items required after the purchase order has been placed will incur an additional charge.

Aussie Balustrading & Stairs’ standard stair quote includes treads fixed on top of the plate (not recessed) unless otherwise specified by the client. Any modifications to this standard design must be communicated in writing- via email or message- before the drafting team makes the drawings.

Removal of existing balustrade is not included in our standard quotation. If required, this must be clearly requested by the client and reflected in the quote.

Confirmation

Once the deposit invoice is paid and/or the drawings are confirmed by the client/buyer, it confirms the acceptance of all the details specified in the quote/invoice by the client/buyer.

Aussie Stairs will not be liable for any changes after the clients have confirmed the job unless additional fees are paid.

Delays

Aussie Stairs is not responsible for any delay caused by something beyond our sole control including any failure of the Client to (a) make a selection, or (b) give reasonable clear and unobstructed access to site. This also includes delays in deposits. The project will be rescheduled on next available time slot. 

If the client delays the site installation for any reason, Aussie Balustrading & Stairs reserves the right to charge a cancellation fee if a cancellation is done within 48hrs of the installation date. The job will be rescheduled based on the availability.

If a project has been made as per the client’s request, and there are delays exceeding three months then Aussie Balustrading & Stairs reserves the right to impose stock holding fee.

Unforeseen Circumstances

When and where applicable to the installation, it is the responsibility of the Client to inform Aussie Stairs of the location of any known and hidden pipes and services such as, but not limited to, water pipes, drainage pipes, electrical wiring, reticulation, plumbing, drainage, soak-wells and sewerage services. Aussie Stairs is not responsible for any problem with the site that is only revealed when carrying out the works. Aussie Stairs will request a variation for any extra work required to fix the problem.

For installation on stud walls, our team will make every effort to locate the studs with precision. However, we cannot accept liability for any unintentional damages that may occur during the installation process.

Structural steel surfaces may naturally exhibit some lines, marks or minor scratches due to the manufacturing process. While we strive to achieve the smoothest possible finish, slight imperfections may be present.

In the event of accidental damage caused by ABS, the client shall not engage or permit any third-party trade to undertake rectification works without the prior written consent of ABS. A written quote must be submitted to ABS for approval prior to any work commencing. ABS will not be liable for any works commenced/completed without their written consent.

Site Conditions

The Client must have the site ready when required by Aussie Stairs. Typically the site should be finished and ready for installation. Pre-production measurements are very precise, and enable us to achieve a superior finish. 

Aussie Stairs quotation allows for only one site visit for measuring, and therefore it is essential that the surface to which we are fixing is finished. 

Should multiple measuring trips be necessary (through no fault of Aussie  Stairs) than extra costs associated with this will apply at the client’s cost.

If the wall where Aussie balustrading & Stairs is working on, contains a cavity, it must be filled with concrete by the client. Aussie Balustrading & Stair is not responsible for carrying out this work. It is the client’s responsibility to ensure the wall is prepared prior to site measurement.

Risk

Aussie Stairs retains property in the goods nonetheless, all risk for the goods passes to the client on delivery to the client’s job-site.

During onsite welding, it is the client’s responsibility to implement necessary precautions to protect surrounding areas/property, including but not limited to windows, stairs, furniture, tiles and timber flooring. Aussie Stairs will take all reasonable care to minimize risk; however, ultimately the responsibility remains with the client.

Installation Lead Times

Installation lead times may fluctuate based on seasonal production demands. Aussie Stairs standard lead time is contingent upon the site's readiness for measurement and installation. However, unforeseen factors like weather may occasionally affect these timelines. While Aussie Stairs strives to adhere to planned installation dates, they cannot provide absolute guarantees. 

It's important to note that Aussie Stairs lead times commence after the site is ready for measurement and deposit has been paid. If the site is not prepared as indicated upon the Aussie Stairs team’s arrival, it may result in delays and additional costs for the client. 

Fixing to Pre-Finished surfaces

When fixing to a pre-finished surface, it is vital that the surface is solid and free of voids. This will ensure maximum fixing strength as well as reducing the possibility of damaging the surface material. If bricks are used it is recommended that the top course is solid brick. 

Tile and Marble surfaces

Aussie Stairs will take full care when fixing to tiles and marbles but take no responsibility for damages that may occur during our installation.

Painted Walls

Aussie Stairs is not liable for any damages, paint chip off and scratches caused during the process of installation.

Timber Decking

Where the fixing is on to timber decking, the Client may be required to supply and install additional timbers under the timber deck, along the centreline of the balustrade, for solid fixing purposes. It should be kept in mind that timber is a natural product and subject to shrinkage and expansion and as such fixings directly onto timber will most likely loosen over time. Timber will also “flex” and movement may transfer through the balustrade. This is to be expected.

Copyright

Aussie Stairs owns all copyright (which also includes Moral rights) in the products, installation processes, works, plans, specifications and workshop drawings created by Aussie Stairs as the Contractor. If you give Aussie Stairs any sketch, plan or other document which infringes someone else’s copyright, you agree to indemnify AUSSIE STAIRS and/or the Contractor against all claims and costs.

Scaffold

The client is responsible for providing a safe working environment. Any scaffolding required to complete the project safely is to be on site prior to commencement of the job. All scaffolding cost is a responsibility of the client.

Aussie Stairs shall not be responsible for removing or installing scaffold during site installation. If scaffold is not removed and obstruct Aussie Stairs to complete site work, Aussie Stairs may remove the scaffold but does not bear any responsibility if any damages occur to scaffold and property during scaffold removal.

Joints

Any handrails above 6m lengths require a joiner sleeve. Joints may have 2-4mm gaps.

Balustrades supplied or installed by Aussie Stairs come standard with tack welding only. Full welding is available on request and will incur an additional cost.

Powder-Coat

Aussie Stairs takes no responsibility for any powder-coated chipping or fading after the project has been completed. Goods are Coated with all care however with no liability to Aussie Stairs.

Timber Treads

Putty may not 100% match the timber colour but we use the most suitable putty. Any timber cracks, Aussie  Stairs is not liable as its a natural material.

If the clients elect to install timber treads over a concrete stair or surface, Aussie Stairs shall bare no responsibility or liability for any future issues, including but not limited to lifting or detachment of the timber.

In instances where the clients want Aussie Stairs or a third party to install side-fixed glass balustrade on 42mm treads supplied by Aussie Stairs, the company accepts no liability for any resulting damage or cracks to the treads.

Upon the installation of the final treads, unless provisions have been made in the contract to protect them, the client assumes full responsibility for any damage incurred thereafter as the site is then open to other trades. Aussie Stairs shall not be held liable for any damage to the treads following completion of installation of the treads.

Variations in natural timber is inherent and beyond Aussie Stairs’ control. As such Aussie  Stairs cannot guarantee uniformity in color, grain, or texture.

In events where Aussie Stairs are not responsible for installing the final treads as per the contract, the client must notify ABS once the final treads have been installed, so that the company may retrieve the temporary treads.

Glass Pricing

Aussie Stairs does not hold glass prices even if a deposit has been paid. Aussie Stairs has no control over glass pricing. Prices may vary at the time of cutting the glass according to the current market price.

Removal

If Aussie Stairs have been asked to remove a balustrade as part of our works, Aussie Stairs are not liable for any cracks to concrete or floor. If any repairs are required to the concrete or floor, this shall be arranged by the client or builder.

Site preparation before Aussie Balustrading & Stairs installers come on site

Client provides us with suitable access to the work area. Access to power and lighting must be provided by the Client. Any Project requiring site welding, we require 15Amp power sockets. 

Removal of all materials obstructing the balustrade, handrails or stairs for carrying to the installation location is the responsibility of the Client and must be completed before work can begin.

All other trades must have finished their work in the area. Delivery vehicles must be able to park within a suitable distance of the work area for the unloading of product by hand. Inability to do so may result in an extra delivery fee added to your final invoice to cover labour costs.

During Installation 

All possible care will be taken during the installation process, however small chips or marks may occur on or to walls and fixtures, fittings or installations. Aussie  Stairs is not liable to repair any such damage.

To ensure a smooth installation process, the client shouldn’t have installed/completed the flooring (Tiles, Carpet, Timber, etc.) prior to Aussie Balustrade & Stairs completing the staircase installation. During the installation process, a temporary lifting system must be installed on the top slab to lift the stairs. If the flooring has been installed prior to the staircase installation, Aussie Balustrading & Stairs will try their best to proceed with caution but will not take any responsibility for any damages that may occur to the flooring.

After Installation

Any defects in our product must be reported within a day. Aussie Stairs will not be liable for any scratches, damages, dents to glass, handrail, spigots, pins, timber treads after that 2-days period. No complaint will be considered by Aussie Stairs until all invoices and outstanding sums are paid in full. If no complaint is submitted within 2 day, then to the extent permitted by law, the goods and/or services will be treated as having been accepted and any final payment must be made in accordance with these Terms and Conditions.

Following installation, ongoing care and maintenance of the balustrade is the responsibility of the client to prevent damage and minimise the risk of tea staining.

Note: Tea Staining is natural phenomenon that requires regular cleaning and maintenance.

You agree, to the extent permitted by law, to indemnify and hold Aussie Stairs, its directors, officers, employees, affiliates, agents, contractors, and licensors harmless with respect to any loss, liability and claims arising directly or indirectly from or in connection with the products and services supplied by Aussie Stairs. This includes but is not limited to being liable for any loss or damage to Aussie Stairs business caused by defamatory or slanderous comments made on social media or other media.
